These Terms and Conditions govern your use of the TCIQ platform and services operated by Transition Care Intelligence LLC ("TCIQ", "we", "us", or "our"). By using our services, or by receiving calls from us on behalf of a participating skilled nursing facility, you agree to these terms.
Automated Follow-Up Calls
Consent to Receive Calls
Follow-up calls are placed only to residents or family contacts whose consent the skilled nursing facility obtained and recorded during the discharge process. Consent is not a condition of receiving care. You may withdraw consent at any time by telling the facility or emailing support@gotciq.com, and we will stop calling that number.
Not an Emergency Service
TCIQ is not an emergency service and does not monitor calls in real time. If you are having a medical emergency, hang up and call 911. If you are in crisis or thinking about harming yourself, call or text 988 to reach the 988 Suicide & Crisis Lifeline.
Platform Terms (Facility Operators)
Skilled nursing facilities and their staff who access the TCIQ platform agree to:
- Use the platform only for lawful post-discharge care coordination purposes
- Obtain and record appropriate resident or family consent before any follow-up calls are placed through TCIQ
- Tell TCIQ promptly when a resident or family contact asks the facility to stop the calls
- Maintain the confidentiality of login credentials and limit access to authorized staff
- Comply with all applicable federal and state laws, including HIPAA, the Telephone Consumer Protection Act, and CMS regulations
- Execute a Business Associate Agreement (BAA) with TCIQ before any protected health information is processed
A fully executed Business Associate Agreement with TCIQ is a prerequisite to platform activation. Access to the TCIQ platform will not be provisioned until a BAA is in place. The BAA is incorporated by reference into these Terms.
Permitted Use
The TCIQ platform may only be used for post-discharge care coordination, clinical follow-up, CoreQ satisfaction survey administration, and related care management purposes. Use of TCIQ for marketing, solicitation, or any purpose unrelated to patient care is prohibited.
Intellectual Property
All content, software, and materials on the TCIQ platform are the property of Transition Care Intelligence LLC. You may not copy, reproduce, or distribute any portion of the platform without our express written permission.
Disclaimers
TCIQ is a care coordination technology platform. It is not a medical device, does not provide medical advice, and does not replace clinical judgment. Check-in calls use artificial intelligence to hold a conversation on behalf of your skilled nursing facility, within defined limits. The call asks about a set of warning signs that TCIQ generates from the diagnoses recorded for that resident, and that the facility's discharge coordinator reviews with the resident at discharge; the signs are not taken from the facility's written discharge instructions. When a resident reports one of those signs, the call speaks a fixed, pre-written line rather than wording of its own. The calls are designed not to diagnose, interpret symptoms, or recommend treatment, and an automated screen checks what is spoken — that screen is a safeguard, not a guarantee. The satisfaction survey call is scripted.
TCIQ may flag concerns raised during a call for follow-up by facility staff. Each warning sign carries a severity set in advance — some are treated as reasons to contact the provider, and some as reasons to call 911 — and the call speaks the fixed line for that severity. TCIQ does not judge how serious a resident's particular situation is, and does not perform a clinical assessment. TCIQ is not responsible for outcomes resulting from facility staff's failure to review, act on, or respond to concerns flagged by the platform. Clinical response decisions remain solely the responsibility of the participating facility and its licensed personnel.
Limitation of Liability
To the fullest extent permitted by law, TCIQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or services. Our total liability shall not exceed the greater of (a) the amounts paid by you for the services in the preceding 12 months, or (b) five thousand dollars ($5,000).
Governing Law
These Terms are governed by the laws of the State of Iowa, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Scott County, Iowa.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms at this URL with a revised effective date. Continued use of our services after a change constitutes acceptance of the updated Terms.
